Ways to Establish Paternity in Virginia
The appropriate method for establishing legal fatherhood depends on whether both parents agree, the mother’s marital status, whether someone else is a presumed legal father, and whether an order already exists. We assess those circumstances before recommending a course of action.
The available path generally falls into one of three categories:
- Acknowledgment of Paternity: Both parents may voluntarily sign this written statement identifying the child’s legal father. Parents should understand its legal effect before signing.
- Virginia DCSE involvement: The Virginia Division of Child Support Enforcement, commonly called Virginia DCSE, may assist with establishing paternity and arranging genetic testing in qualifying cases.
- Court proceedings: When parentage is disputed or voluntary acknowledgment isn’t appropriate, a court may consider testimony, records, genetic testing, and other evidence before entering an order.
Agency assistance can address certain procedural needs, but it isn’t a substitute for advice based on your family’s circumstances. Court involvement may also be necessary when the dispute includes custody, visitation, or support.
