Military Retirement Division in Virginia Beach

Military Retirement Guidance Backed by More Than 31 Years of Experience

Military retirement can be one of the most consequential assets addressed in a military divorce. Edge Law, P.C. represents military members and spouses in Virginia Beach, applying more than 31 years of military family law experience to the federal and Virginia rules governing these benefits.

Our representation covers the Uniformed Services Former Spouses’ Protection Act, retirement division, survivor coverage, and protections under the Servicemembers Civil Relief Act. We explain how these rules may affect property division and prepare for negotiation or litigation as circumstances require.

How Virginia Divides Military Retirement

The Uniformed Services Former Spouses’ Protection Act allows state courts to treat disposable military retired pay as marital property. This is the portion of retirement pay remaining after deductions excluded by federal law. The statute permits division but doesn’t automatically entitle a former spouse to a particular percentage.

Virginia uses equitable distribution to identify, value, and fairly divide marital property. Retirement benefits earned during the marriage may be included in that process. Virginia law limits a former spouse’s award from the marital share of retirement cash benefits actually received to 50 percent.

The 10/10 Rule & DFAS Direct Payment

The 10/10 rule determines how an awarded share is paid, not whether a spouse has a right to receive one. When the marriage overlapped with at least 10 years of creditable military service, the Defense Finance and Accounting Service, commonly called DFAS, may send qualifying payments directly to the former spouse.

A marriage that doesn’t satisfy the 10/10 rule may still result in an award of retirement benefits under Virginia law. DFAS direct-payment eligibility and the underlying division of military retirement are separate questions. We evaluate both so clients understand the award and the available payment mechanism.

Military Retirement Calculations & Virginia Jurisdiction

Retirement division requires separate analysis of the benefit calculation and the court’s authority over the military member. Neither issue should be assumed based only on where a divorce complaint is filed.

The Frozen Benefit Rule

When a military member hasn’t retired by the time the divorce order is entered, the Frozen Benefit Rule generally bases the former spouse’s share on the member’s rank and years of service at that time. Post-divorce promotions don’t increase that share. The calculation isolates the retirement benefit associated with the service recognized at divorce rather than later career advancement.

Authority to Divide Military Retirement

A Virginia court may divide military retirement when the military member is domiciled in Virginia, resides in Virginia for a reason other than military orders, or consents to the court’s jurisdiction. Being stationed in Virginia doesn’t by itself establish the necessary authority. This federal rule can determine whether retirement division proceeds in a Virginia case.

Military divorce and equitable distribution matters involving Virginia Beach residents and service members are typically heard in Virginia Beach Circuit Court. We examine jurisdiction before asking the court to divide retirement benefits, identifying an issue that might otherwise complicate property division.

Other Military Benefits Requiring Separate Treatment

Retirement pay isn’t the only benefit that may require attention during divorce. Survivor coverage, retirement savings, and military disability benefits follow different rules and shouldn’t be treated as interchangeable assets.

Survivor Benefit Plan

The Survivor Benefit Plan provides continuing income to one designated beneficiary after a participating military member’s death. A settlement may award former-spouse coverage to the non-military spouse. Depending on the elected base amount, the benefit can provide up to 55 percent of that amount after the member dies.

Thrift Savings Plan

A Thrift Savings Plan is a separate retirement asset that may be subject to division in divorce. Its value and treatment must be considered apart from military retired pay and survivor coverage. Keeping these assets distinct allows each to be addressed under the rules governing it.

Military Disability Pay

Military disability pay is excluded from disposable retirement pay under the Uniformed Services Former Spouses’ Protection Act and can’t be divided as marital property. Because disability pay and divisible retirement benefits receive different treatment, the character of each payment matters when evaluating military divorce retirement issues in Virginia Beach.
